Court to Clarify Definition of Fraud in Charitable Fund-Raising

Date: November 5, 2002
Author: Linda Greenhouse
QUOTE: ...the Supreme Court agreed today to clarify the boundary that separates charitable solicitation from consumer fraud.

ABSTRACT: States call for a reevaluation of the constitutional right (under the First Amendment) which protects alleged telemarketing trickery wherein a telemarketing firm fundraises for a charity and keeps the majority of the profits. Also included in this summary of Supreme Court Cases: the legal battle for a mentally ill defendant to refuse medication when on trial, and the appeal of a second Vietnam veteran lawsuit against manufacturers of Agent Orange, a potentially harmful chemical.
