Visa Suit: Dictionary Discredited

Date: November 16, 2002
Author: Paul Boutin
QUOTE: Domain disputes are a dime a dozen, but legal experts say Visa's recent win over a one-man website is the first time a corporate trademark has prevailed over a word in the dictionary.

ABSTRACT: Visa's trademark on "visa" was upheld in a Nevada district court. Visa had sued evisa.com believing the website's address could dilute the power of the Visa name. Critics of the ruling insist this is a step in restricting "visa," a word commonly found in the dictionary, for anything related to travel services. Eventhough the founder of evisa.com believes Visa has a right to protect the company's name, he still contends the ruling is unfair.
