Justices Say F.C.C. Wrongly Seized Wireless Licenses

Date: January 27, 2003
Author: David Stout
QUOTE: The United States Supreme Court ruled, in a case of great importance for the telecommunications industry, that the federal government was wrong when it took back wireless communications licenses from a bankrupt company in 1998.

ABSTRACT: The Supreme Court ruled that the Federal Communications Commission (FCC) wrongly repossessed the licenses of a company that had filed for bankrupt protection. In the majority opinion, Justice Antonin Scalia wrote: 'The government is not to revoke a bankruptcy debtor's license solely because of a failure to pay his debts.'
