ACLU Challenges Wire-Tap Decision

QUOTE: The American Civil Liberties Union and the National Association of Criminal Defense Lawyers, along with Arab-American groups, petitioned the Supreme Court on Tuesday to review the decision by a secret court to broaden the government's ability to conduct secret surveillance.

ABSTRACT: A secret Foreign Intelligence Surveillance Act (FISA) court has made it significantly easier for the government to conduct secret surveillance, erasing the need for "probable cause," narrow scope, and prior notification. The American Civil Liberties Union, National Association of Criminal Defense Lawyers, and Arab-American groups have petitioned the Supreme Court to review the decision since it significantly erodes Fourth Amendment protections. This is the first review of a case involving FISA courts, which constitute within the intelligence domain a parallel judicial system with regular and appeals courts.
